This appeal by appellant, Roger Schlossberg, Trustee in Bankruptcy for the Estate of Jorgen L. Larsen, Bankrupt, seeks reversal of the judgment of the Circuit Court for Prince Georges County granting motions for summary judgment filed by Philip E. Epstein, Marvin B. Miller, and State Farm Mutual Automobile Insurance Company, appellees. Appellants action against appellee State Farm was based upon State Farms alleged negligent and bad faith failure or refusal to settle an underlying tort action, which resulted in a judgment in excess of Larsens automobile insurance policy limits. His action against appellees Miller and Epstein sounded in professional malpractice. The trial judges stated reason for granting the motions for summary judgment is that Larsens election to file bankruptcy, rather than assign his causes of action to the plaintiff in the underlying tort action, as a matter of law, constituted a failure to mitigate damages.
