Petitioner had been charged and convicted of a felony in the state of New Mexico, served a portion of his sentence and was released on parole. While on parole, he allegedly committed an offense of violence which constituted a violation of the terms of his parole. He departed the state of New Mexico and was arrested on a fugitive criminal complaint and incarcerated in Boulder County jail. Subsequently, a governors warrant was issued at the request of New Mexico authorities. The petition for a writ of habeas corpus followed.
